CARD Bank Inc. – konek2CARD Terms and Conditions

These Terms and Conditions shall govern your use of the mobile money services available through konek2CARD, our mobile money services application.

In these Terms and Conditions:

“konek2CARD” an application refers to mobile financial services that CARD Bank, Inc. Offers through CARD Bank Mobile Money Services, where customers can perform various bank transactions simply by using their mobile phone wherever they have cellular network coverage.

“Savings Account” refers to the account held with CARD Bank in the depositor’s name or personal account. Joint account will not be allowed.

“Mobile PIN” refers to the client identification Number (PIN) nominated by the account holder used to authorize every transaction through CARD Bank Mobile Money Services.

“Mobile Password” refers to the personal password nominated by account holder used to login in the mobile application.

“We”, “Us”, “Our”, and “Bank” refer to CARD Bank, Inc.

“You” and “Your” refer to the owner of the account.

Access to konek2CARD

You may access your account through the konek2CARD application using your mobile phone. konek2CARD services will be available only for the CARD Bank accounts you enrolled.

The activation of konek2CARD account is done by sending an SMS with a correct information and order. The CARD Bank, at its sole discretion, reserves the right to validate the information provided by you. Once your information has been validated, you will receive a confirmation from the CARD Bank through mobile application.

Your registration in konek2CARD will be effective upon your receipt of the Bank’s confirmation of the registration of your accounts in konek2CARD and will remain in full force and effect until we receive from you a notice of its termination.

In the event that the mobile phone used to access konek2CARD was replaced, you must install new mobile application on your new mobile phone and call the customer service to request for deactivation to proceed in re-enrollement..

Mobile phone, Username, Mobile Password & Mobile Personal Identification Number Security.

You shall keep your Username, Mobile Password, MPIN, account number and other account data confidential and secured at all times.

You agree to assume full responsibility and liability for all transaction made in your accounts through the use of your konek2CARD application, Username, Mobile Password and MPIN. It is understood that the Username, Mobile Password and MPIN is known only to you and as such, any transaction effected using your Username, Mobile Password and MPIN shall be conclusively presumed to be done by you or authorized by you.

You agree that the CARD Bank, at its sole discretion, is entitled to act on the instructions received from you through konek2CARD after the correct entry of your Username, Mobile Password and MPIN. You further agree that the CARD Bank shall not be liable for acting in accordance with or based on requests/instructions received through konek2CARD, which we believe emanates from you.

As a safety measure, you further agree and undertake to change your Mobile Password and MPIN from time to time as you deem necessary. If you believe that your mobile phone, Username, Mobile Password or MPIN may have been lost/stolen or that someone has used it without your permission, you shall notify the CARD Bank Customer Service immediately and shall give the latter a reasonable period to de-activate your compromised konek2CARD account Username, Mobile Password and MPIN.

You must keep your Username, Mobile Password and MPIN totally confidential and secured at all times and not to reveal it to any third party.

When changing your Mobile Password and Mobile Personal Identification Number (MPIN), choose a Password and MPIN which must not relate to any readily accessible data such as your address, telephone number, driver’s license, date of birth etc., and easily guessable combination of numbers. Do not let any unauthorized person have access to your mobile phone or leave your mobile phone unattended while accessing konek2CARD.

Authority to the CARD Bank

Your banking transactions are permitted through konek2CARD only after authentication of your Username, Mobile Password and MPIN and your instructions made after such authentication shall be sufficient authority to the CARD Bank for carrying out the banking transaction by you through the application.

The confirmation message that is sent to your mobile application inbox at the time of operation of the konek2CARD application is merely your personal record of the operation of the konek2CARD and shall not be construed as the CARD Bank’s record of the relative transactions.

In case of discrepancies, the CARD Bank’s own record of transactions maintained through computer system or otherwise shall be accepted as conclusive and binding for all purposes unless any discrepancy is pointed out within a week from the date of sending the periodical statement to you.

Accuracy of information

The CARD Bank will use reasonable efforts to ensure the accuracy of information accessed through konek2CARD but does not warrant the information will be free from error. Hence, you are solely responsible for the correctness of information supplied to the CARD Bank through the use of konek2CARD through any other means such as electronic mail or written communication. The CARD Bank accepts no liability for the consequences arising out of erroneous information supplied by you through konek2CARD. If you suspect that there is an error in the information supplied to the CARD Bank, you shall advise the CARD Bank as soon as possible. The CARD Bank will endeavor to correct the error wherever possible.

If you notice an error in the account information supplied to you through konek2CARD or by the use of any of the konek2CARD or by the use of any of the konek2CARD services, you shall advise the CARD Bank as soon as possible. The CARD Bank will endeavor to correct the error promptly and adjust any interest or charges arising out of the error.

General Agreements

By using these services, you agree to be bound by the Terms and Conditions that will be made available to you concerning these products & services. CARD Bank may notify any changes on the existing konek2CARD services or introduce new Products thru this mobile application.

CARD Bank does not guarantee the continuous availability of all konek2CARD services mentioned in this agreement. CARD Bank reserves the right to terminate or suspend any konek2CARD services with prior notice to you.

CARD Bank shall not be liable for any loss or damage of whatever nature in connection with the implementation of mobile transactions in the following instances:

  1. Disruption, failure or delay relating to or in connection with the konek2CARD services which are due to circumstances beyond the control of the CARD Bank, unforeseen events, fortuitous events such as but not limited to prolonged power outages, breakdown in computers, software, operating systems and telecommunication facilities, typhoons. Floods, public disturbances and calamities and other similar or related cases.
  2. Loss or damage arising out of any fraudulent access or utilization of the konek2CARD services due to theft or unauthorized disclosure of mobile phones, Mobile password, MPIN or violation of other security measure used, with or without your participation.
  3. Inaccurate, incomplete or delayed information is received due to disruption or failure of any information or communication facilities used for the CARD Bank System, or due to faults in the telecommunication network, internet or network failure, or software or hardware error beyond the control of the CARD Bank.
  4. Any indirect, incidental or consequential loss, loss of profit or damage suffered by reason of the use or failure or inability to use the konek2CARD services.
  5. Any and all liability, costs, damages, losses and causes of action arising from or in any way connected with the disclosure of information concerning your accounts and/or transactions with the Bank to authorized persons for any reason whatsoever, including but not limited to wiretapping of communication switches, or errors in transmitted information due to faulty lines, and any and all forms of high technology surveillance or fraud.

Service Charges and Taxes

You agree to pay the charges that may be imposed by the CARD Bank when availing of services and/or products under konek2CARD and the standard SMS, data and call rates that will apply in the course of konek2CARD transactions. We will deduct the charges directly from your deposit account balance as these were incurred. We are not responsible for the monitoring of your mobile phone charges. It is your responsibility to monitor these charges and to ensure that you have enough mobile credits to transact using the CARD Bank’s konek2CARD application. We will not be liable for dishonor of other debits to your deposit account resulting from our deduction of any charges as authorized by your acceptance of these terms.

We reserve the right to change the charges, fees, or other terms described in these Terms and Conditions. When changes are made and/or fees, charges or other material terms are added we will update this konek2CARD Terms and Conditions, or send a notice to you through Mobile App in Broadcast Inbox.

You agree to be responsible to any updates to these Terms and Conditions and you agree that your continued use of the konek2CARD services after the effectively of any changes to the Terms and Conditions and adherence to such changes.

As always, you may choose to decline changes by discontinuing the accounts or services to which these changes relate. We also reserve the option, in our business judgment, to waive, reduce or reverse charges or fees for individual situations.

Termination of the Agreement

You may request termination of the konek2CARD Service by calling CARD Bank’s Customer Service to process your request. You shall remain responsible for any konek2CARD cancellation of the konek2CARD Service.

The agreement comprised in these Terms and Condition shall be deemed to remain in full force and effect if and in so far as any transaction is completed but not debited to your account/s prior to termination of the konek2CARD Service shall not prejudice or omitted to be done prior to termination thereof.

The CARD Bank may, for security and other reason, withdraw the konek2CARD Service anytime you are given reasonable notice under the circumstances. If the konek2CARD Service is erroneously or negligently withdrawn by the CARD Bank for any reason other than your breach of the terms and conditions hereof, the CARD Bank’s liability shall be restricted to the return of the annual charges, if any, recovered from you for the period in question.

The closure of all your accounts enrolled on the Mobile Banking Service will automatically terminate the service.

The Bank may suspend or terminate your mobile banking service with notice if you breach any of the terms and conditions hereof of the Bank learns of your death, bankruptcy or lack of legal capacity.

Miscellaneous

These terms and conditions and the banking practice and charges relating thereof may be changed by the CARD Bank at any time by notice thereof of the account holder. Any such changes will be effective from the date of the notice or suck later date as may be specified therein.

Should the CARD Bank become involved in any litigation which may have relation with this Agreement, or with any of the rights, powers and remedies hereunder, all fees and expenses incurred by the CARD Bank in such a litigation, including a reasonable amount for the attorney’s fees which amount is hereby agreed to be at the rate of 10% of the sum sought, shall be paid by the client.

This konek2CARD Agreement is governed by the provisions of Bangko Sentral ng Pilipinas and applicable laws of the Philippines relating to the covered transaction herein. It shall be understood that access to and use of the konek2CARD Service shall be subject to applicable requirements and procedures of government telecommunications or other regulatory authorities and those prescribed by law.

The venue of all legal actions proceeding arising out of or in connection will these Terms and Conditions shall be brought only in the proper courts to the exclusions of all other venues.

Waiver and Consent

I hereby agree to be governed by the terms and conditions including the amendments relative to this account.

I signify my consent and agree that CARD Bank, Inc. (A) May collect, use and disclose my personal data, as provided in this document, or obtained by CARD Bank, Inc, as a result of being its client, for the purpose of processing this document and (B) To the disclosure and sharing of the said information to CARD Bank subsidiaries/affiliates; and further understand that I have a right to amend/revise the information that I have provided including deletion of the said information, in accordance with the data privacy of 2012 and CARD Bank, Inc. Data Protection Policy.

The company may also use my contact details, demographic information to contact me with marketing or promotional information regarding products, services and studies/surveys to be conducted by CARD Bank and CARD MRI including phone calls, mail, Email, SMS or any type of electronic message. The company may further use my personal data for the purpose of providing services to me or for other reasonable purposes which are related to the services it provides or improvements/upgrade in its system and business process (including but not limited to data analytics, automated processing, etc.)

CARD Bank Inc. – konek2CARD Data Privacy Policy

  1. Introduction
